Terms of service.

These terms govern your use of Cult Shield. They are written in plain English. If something is unclear, email legal@cultshield.com and we will rewrite the relevant section.

1. Who you are dealing with

Cult Shield is operated by Cult Shield s.r.o., a Slovak limited company registered in Bratislava. References to "we", "us", or "Cult Shield" mean this company. References to "you" mean the natural person or entity using the service.

2. What the service does

Cult Shield monitors selected online marketplaces for listings that appear to infringe the copyright of 3D model files (and, over time, other digital works) for which you are the rights holder. When a likely infringement is detected, Cult Shield drafts a takedown notice under DMCA §512(c)(3) or the equivalent statute in your selected jurisdiction, and (on your approval) files the notice with the relevant marketplace, host, and payment processor.

3. Limited power of attorney

To file a notice on your behalf, the law requires that you authorize an agent. By accepting these terms and uploading work to Cult Shield, you grant Cult Shield s.r.o. a limited, revocable power of attorney for the sole purpose of filing copyright takedown notices and related correspondence concerning works you have uploaded.

4. Your representations

You represent and warrant that, for every work you upload:

Filing a knowingly false notice is a federal crime under 17 U.S.C. §512(f) and exposes you to damages. Cult Shield's drafting workflow is designed to reduce that risk, but the final approval is yours.

5. What you keep

You retain all rights in the files you upload. Cult Shield never claims ownership of your work. Cult Shield obtains only a narrow processing right (to fingerprint, hash, render, and store the files for the purpose of providing the service to you).

6. What we keep

Cult Shield retains the audit log of all notices we draft and file on your behalf, including the underlying evidence (timestamps, screenshots, hashes). Retention period: seven years from notice filing, mirroring the statute of limitations under U.S. copyright law. You can request export of your audit log at any time.

7. Acceptable use

Violation of acceptable use is grounds for immediate account termination without refund.

8. Pricing and refunds

Plans are billed monthly in advance via Stripe. You may cancel at any time; cancellation is effective at the end of the current billing period. We refund the most recent payment if (a) you cancel within seven days of first payment and have filed fewer than three notices, or (b) Cult Shield fails to deliver a paid feature and we cannot resolve the issue within fourteen days.

9. Recovery tier commission

On the Recovery tier, Cult Shield retains 30% of any monetary recovery obtained from an infringer as a direct result of our work. The remaining 70% is paid to you in the currency of recovery. The commission applies only to amounts actually received; we charge nothing on takedowns without monetary recovery.

10. Service level

We commit to the response-time targets published on our status page. Service credits for downtime are detailed on the same page. We do not guarantee that any given marketplace will honor any given notice; that decision is the marketplace's.

11. Liability

To the maximum extent permitted by law, Cult Shield's aggregate liability to you under these terms is limited to the amount you have paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, or punitive damages.

12. Indemnity

You agree to indemnify Cult Shield against claims arising from (a) your breach of the representations in Section 4, (b) your upload of work you do not own, or (c) any monetary award against Cult Shield resulting from a notice you authorized but which a court later finds to have been knowingly false.

13. Governing law

These terms are governed by Slovak law. Disputes are subject to the exclusive jurisdiction of the courts of Bratislava, Slovak Republic, except where applicable consumer-protection law gives you a non-waivable right to sue in your home jurisdiction.

14. Changes

We may update these terms. Material changes will be announced by email and posted here with the effective date. Continued use after the effective date constitutes acceptance.
