What a valid notice must include

Under DMCA §512(c)(3)(A), a notification of claimed infringement must contain:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing, and information reasonably sufficient to permit us to locate the material.
  4. Information reasonably sufficient for us to contact you, including your address, telephone number, and email.
  5. A statement that you have a good-faith belief that the use complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.

Counter-notification

If you believe content was removed in error, you may send a counter-notification under §512(g) to the same address. Counter-notifications are forwarded to the original complainant and to the relevant marketplace within 10 business days unless we receive notice of a court action seeking to restrain the alleged infringing activity.

Repeat infringers

It is our policy to terminate the accounts of users who are determined to be repeat infringers of copyright in appropriate circumstances, as required by §512(i)(1)(A).

Misrepresentations

Under §512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, is liable for any damages incurred by the alleged infringer, the copyright owner, or the service provider. Please file notices honestly.
